Contingency Fees - What is a contingency fee?
Contingency fee arrangements permit persons with limited resources to retain a personal injury lawyer to assist in pursuing and obtaining legal remedies such as awards of compensation for injuries sustained.
As your personal injury lawyers, we do not charge hourly rates and are therefore assuming some of the financial risks associated with the personal injury cases we handle. Our fee arrangements reflect this shared risk.
With a contingency fee, whether or not fees are paid and the amount of the fee to be paid is contingent on the result obtained. In certain cases, you may be required to pay disbursements such as the cost of retaining experts or obtaining hospital records. Why do I need to sign directions to release information and documents to my lawyer?

One of the questions that we are often asked by new clients is ‘What is a direction and why do I need to sign them? ‘ In Ontario, every person has a right to privacy. Therefore, in order for your personal injury lawyer to access records kept about you by other people, your lawyer needs you to sign a direction directed to those other persons allowing them to share their files with or speak with your accident lawyer.
Think of a direction form as a permission slip. A signed direction is your way of giving permission to third parties such as Revenue Canada and your doctors to share information with us about you and your legal matter. Directions, sometimes also called authorizations allow your personal injury lawyer to contact third parties to obtain the information they need to help advance your injury claim and prove certain elements of your claim such as loss of income or your injuries.

Ottawa Disability Lawyers - Ontario Court of Appeal Upholds Judgment of Damages Against Insurer for Mental Distress
The Ontario Court of Appeal has sent a loud and clear messages to insurers and their adjusters on how to act reasonably in cases of injured persons seeking benefits. If an insurer denies benefits despite clear medical evidence of disability/injury, the Court will award damages to the disabled person above and beyond benefits.
This decision clarifies, in part, how minor injury claims will be handled. In the court judgment of McQueen v. Echelon General Insurance Co., the Ontario Court of Appeal refused to overturn an award of $25,000 for mental distress caused by the denial of benefits.
The case involved a plaintiff who had been in a motor vehicle accident in which she sustained injuries. Prior to the accident, she was already suffering from medical conditions such as bipolar disorder and back pain.
After the incident, the defendant insurer refused to pay for some of the benefits despite the medical evidence supporting an entitlement to benefits. The plaintiff sued seeking benefits and other damages including damages for bad faith and mental distress. She also sought aggravated damages and punitive damages.
The trial judge found that the mental distress warranted compensation. The Ontario Court of Appeal agreed and in its decision stated: “People purchase motor vehicle liability policies to protect themselves from financial and emotional stress and insecurity.
An object of such contracts is to secure a psychological benefit that brought the prospect of mental distress upon breach within the reasonable contemplation of the parties at the time the contract was made.
As an insured person entitled to call on the policy, Ms. McQueen was entitled to that peace of mind and to damages when she suffered mental distress on breach.”
